What information I collect, use, and why
I collect the following information to provide services and goods, including delivery:
— Names and contact details, via the enquiry form
I collect the following information for marketing purposes — this only applies to clients whose galleries have been delivered, not to enquiries:
— Names and contact details
— Marketing preferences
Enquiring alone never results in marketing contact — marketing is only ever opt-in, offered at the point your gallery is delivered.
Lawful bases and data protection rights
Under UK data protection law, I must have a lawful basis for collecting and using your personal information. Which lawful basis I rely on may affect your data protection rights, set out in brief below:
Your right of access — you can ask for copies of your personal information.
Your right to rectification — you can ask me to correct or delete inaccurate or incomplete information.
Your right to erasure — you can ask me to delete your personal information.
Your right to restriction of processing — you can ask me to limit how I use your personal information.
Your right to object to processing — you can object to the processing of your personal data.
Your right to data portability — you can ask that I transfer your personal information to another organisation, or to you.
Your right to withdraw consent — when I use consent as my lawful basis, you have the right to withdraw it at any time.
If you make a request, I must respond without undue delay and within one month. To make a data protection rights request, contact me using the details above.
Our lawful bases for the collection and use of your data
My lawful bases for collecting or using personal information to provide services and goods include consent, contract, and legitimate interests.
My legitimate interest is responding to enquiries about my photography and videography services, providing quotes, and handling the booking process before a contract is confirmed. Processing this information (name, contact details, and what you're enquiring about) is necessary for me to operate as a photography business and respond properly to potential clients. I've considered the impact on your privacy: I only collect what's needed to answer your enquiry, I don't share it beyond what's required to deliver the service, and once a booking is confirmed, the ongoing processing shifts to fulfilling that contract with you rather than this legitimate interest.
My lawful basis for collecting or using personal information for marketing purposes is consent — I have permission from you after giving you all the relevant information, and you can withdraw that consent at any time.
Where I get personal information from
Directly from you.
How long I keep information
Enquiry and booking details (your name, contact details, and what you got in touch about) are kept for up to 2 years from our last contact, after which they're deleted unless you've gone on to book a session with me.
If you book a session, records relating to that booking (invoices, payment records) are kept for 6 years, in line with UK tax record-keeping requirements for sole traders.
Gallery download links remain active for 2 weeks after your photos or videos are delivered — I'd recommend downloading and backing up your files within that window, as access isn't guaranteed after that.
Data processors
I use the following organisations to help me run my business. They process personal information on my behalf, under my instructions, and don't decide what your information is used for — I remain responsible for it:
— Pixieset — hosts my website, contact form, and client galleries
— Gmail (Google) — my email provider
If you're under 18
Some of the people I photograph are under 18. If that's you, here's what happens with your information: I only collect what's needed to arrange and deliver your session — your name and contact details, and a parent or guardian's if they're the one booking. If you're enquiring for yourself and you're under 18, I'll ask that a parent or guardian is involved in confirming the booking and paying the deposit, since that's a financial commitment. You have the same rights as anyone else in this notice, including the right to ask what information I hold about you or to have it deleted — you or a parent or guardian can contact me using the details above to do that.
How to complain
If you have any concerns about my use of your personal information, you can make a data protection complaint to me at enquiries@17starmv.com.
